EPC Info

Any dwelling placed on the market for sale after 1st December 2008 required a Home Report, which includes an Energy Performance Certificate.

With effect from 4th January 2009, properties which were already on the market prior to the 1st December deadline required to have an EPC (although a full Home Report was not needed). In addition to this, any dwelling offered for rental on or after 4th January 2009 must also have an EPC.

As a transitional measure, the Scottish Government introduced amendment regulations which allow building owners a seven day period to react and commission an EPC when a prospective buyer or prospective tenant either, requests any information about the building or to view the building, or makes an offer, to buy or lease the building.  These regulations will expire on 31 March 2009

From 1st April 2009, ALL dwellings offered for sale or rent MUST have an EPC in place, and all properties (both sale and rental) which are to be newly marketed must have the EPC in place before the property is placed on the market.  Failure to obtain an EPC may result in the issue of a Penalty Charge Notice
